These Terms of Service ("Terms") are an agreement between you andAssistive ("Assistive", "we", "us") and govern your access to and use of our websites, apps, and services (the "Service"). By using the Service you agree to these Terms. If you are using the Service on behalf of an organization, you agree on its behalf and confirm you have authority to do so.
The Service
Assistive provides a shared inbox and support tooling that brings website chat and support email into one place and turns messages into trackable tickets. We may add, change, or remove features over time.
Accounts
- You must provide accurate information and keep it up to date.
- You are responsible for activity under your account and for keeping your credentials secure.
- You must be old enough to form a binding contract in your jurisdiction.
- Notify us promptly at [email protected] of any unauthorized use.
Acceptable use
You agree not to:
- Break the law or infringe the rights of others while using the Service.
- Send spam, malware, or harmful or deceptive content.
- Probe, scan, or attempt to breach the security of the Service.
- Reverse engineer, resell, or overburden the Service or its infrastructure.
- Use the Service to build a competing product.
Your content
You and your customers retain ownership of the messages, files, and other content you submit ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely to provide and improve the Service. You are responsible for having the rights and permissions needed to submit it.
Fees and billing
Paid plans are billed in advance on a recurring basis and are non-refundable except where required by law. We may change pricing with prior notice, and changes apply to the next billing cycle. You are responsible for any taxes associated with your use.
Intellectual property
The Service, including its software, design, and trademarks, is owned byAssistive and its licensors and is protected by law. These Terms grant you no rights to our intellectual property except the limited right to use the Service as permitted here.
Third-party services
The Service may integrate with third-party products. Your use of those products is governed by their terms, and we are not responsible for them.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or secure.
Limitation of liability
To the maximum extent permitted by law, Assistive will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
Indemnification
You agree to defend and indemnify Assistive against claims, losses, and expenses arising from your use of the Service or your breach of these Terms, to the extent permitted by law.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. On termination, your right to use the Service ends, and we may delete Customer Data after a reasonable period.
Governing law
These Terms are governed by the laws of Ghana, without regard to conflict-of-law rules. The courts located in Ghana will have exclusive jurisdiction over any dispute, unless applicable law requires otherwise.
Changes to these Terms
We may update these Terms from time to time. When changes are material, we will update the date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
